1. About Ever In Memory
Ever In Memory offers customizable digital memorials, allowing users to compile photos, biographical details, and family stories into a personalized profile page accessible via a unique QR code. Visitors scanning the physical weather-resistant plaque with a smartphone will be instantly directed to the dedicated memorial page showcasing the person's life story.
2. Eligibility
By accessing and using our Services, you confirm that you are at least 13 years old. You agree to use the Website and Services in accordance with these Terms and all applicable local, national, and international laws and regulations.
3. Accounts & Security
When creating an account, you must provide complete, accurate, and current information. You are solely responsible for maintaining the confidentiality of your account credentials and password. You agree to notify us immediately of any unauthorized access or security breach.
4. User Content & Content Guidelines
You retain ownership of any content (biographies, text, stories, images) you upload to Ever In Memory. You are solely responsible for ensuring you have full copyright, permissions, and rights to publish all text and media uploaded. Uploaded content must not be illegal, offensive, threatening, defamatory, or infringe upon third-party intellectual property rights.
5. Memory Package & Subscription Payments
By purchasing the Memory Package, you agree to an initial payment of £11.99. This covers a one-time personalized memorial plaque setup, design, engraving, and postage fee (£10) plus your first month recurring membership (£1.99). Thereafter, a monthly subscription of £1.99 is billed automatically until cancelled.
6. Cancellations & Grace Periods
You can cancel your subscription at any time directly from the "My Account" area of your workspace. Upon cancellation, your membership remains active and editable until the end of your prepaid monthly billing period. After this monthly period ends, editing privileges are suspended, and public page visibility is subject to global administrative configuration parameters.
7. Image Storage & Upload Limits
Members can upload up to 50 images per memorial page. Uploaded files must be in JPEG, PNG, or WebP format and under 5MB per file. We reserve the right to compress or resize images to optimize page performance.
8. QR Code Plaque Delivery & Postage
Custom engraved physical plaques are prepared and posted manually after a memorial page is successfully created. Deliveries are shipped to the billing/shipping address provided during checkout. Shipping times are estimates; we are not liable for postal service delays or events beyond our reasonable control.
9. Intellectual Property & Prohibited Use
The website layout, code, designs, logic, trademarks, and branding are the exclusive property of Ever In Memory. You agree not to copy, scrape, distribute, reverse-engineer, or use automated devices (such as spiders or robots) to monitor or access our Services without prior written consent.
10. Limitation of Liability & Disclaimer
Our Website and Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Ever In Memory, its owners, and employees shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the website, custom plaques, or digital memorial profiles.
